1. Acceptance of Terms
These Terms of Use ("Terms") constitute a legally binding agreement between you and Petal Card LLC, a Delaware limited liability company, with its principal place of business at 800 Delaware Ave Suite 200, Wilmington, DE 19801. By using our website or applying for a loan, you agree to these Terms and our Privacy Policy. If you do not agree, do not use our services.
2. Who Petal Card Is
Petal Card LLC is a licensed direct lender, not a broker or lead generator. We originate, fund, and service short-term consumer loans using our own capital. When you apply at petalcard.us, your application goes directly to Petal Card. We make the lending decision. We deposit the funds. We collect repayment. We do not sell, share, or forward your application to other lenders under any circumstances.
3. Eligibility Requirements
To apply for and receive a Petal Card loan, you must meet all of the following criteria:
- Be at least 18 years of age
- Be a US citizen or lawful permanent resident with a valid government-issued photo ID
- Have a valid Social Security Number
- Reside in a state where Petal Card is licensed to operate
- Have a verifiable regular monthly income of at least $800 from employment, benefits, pension, or another verifiable source
- Have an active US checking or savings account open for at least 90 days that can receive ACH deposits
- Not be subject to an active bankruptcy proceeding
- Have no outstanding unpaid loan with Petal Card
4. Description of Services
Petal Card LLC provides short-term consumer installment loans to eligible US residents. Loan amounts range from $100 to $1,500. Loan terms range from 14 to 30 days. The finance charge is $15 per $100 borrowed. We are the sole lender โ all lending decisions and fund disbursements originate from Petal Card LLC.
Submitting an application does not guarantee approval. Approval is subject to our underwriting criteria, state licensing, and verification of the information you provide.
5. Loan Application
All information you provide in your application must be true, accurate, and complete. Providing false, misleading, or fraudulent information is a violation of these Terms and may constitute fraud under applicable federal and state law, potentially resulting in civil or criminal penalties.
By submitting an application, you authorize Petal Card to perform a soft credit inquiry, verify your identity using third-party identity verification services, verify your bank account information, and contact you via the phone number or email address you provide regarding your application and any subsequent loan.
There is no fee to apply. You are under no obligation until you sign a Loan Agreement.
6. Loan Agreement
If approved, you will receive a Loan Agreement that discloses in plain language: the loan principal amount, the exact finance charge in dollars, the Annual Percentage Rate calculated per the Truth in Lending Act (TILA / Regulation Z), the repayment due date, and the total repayment amount. You are not obligated to sign. Once you provide your electronic signature, the Loan Agreement becomes a binding contract between you and Petal Card LLC.
7. Repayment
By signing a Loan Agreement, you authorize Petal Card to initiate an ACH debit of the total repayment amount from your designated bank account on the due date specified in the agreement. You are responsible for ensuring sufficient funds are available on that date.
Early repayment is accepted at any time with no penalty and no additional charge. To repay early, contact us at +1 (877) 444-0288 or support@petalcard.us. We will process your early repayment immediately.
If you anticipate difficulty making your scheduled payment, contact us before the due date. We may be able to offer an extension, an installment plan, or other arrangement depending on your state and circumstances.
8. Prohibited Conduct
You may not use petalcard.us or our services to:
- Provide false, misleading, or fraudulent information in an application
- Apply for a loan on behalf of another person without their knowledge and written consent
- Apply while ineligible under these Terms or applicable law
- Attempt to obtain multiple simultaneous loans from Petal Card
- Use automated bots, scrapers, or data harvesting tools on our website
- Attempt to circumvent our security measures or access systems you are not authorized to access
- Use proceeds from a Petal Card loan for illegal purposes
9. Intellectual Property
All content on petalcard.us, including the Petal Card name, logo, website design, text, graphics, and software, is the property of Petal Card LLC or its licensors and is protected by US and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written permission.
10. Disclaimers
Nothing on petalcard.us constitutes financial, legal, tax, or investment advice. Petal Card is not a financial advisor. Our products are short-term loans, not a substitute for financial planning, savings, or long-term credit solutions. We strongly encourage you to consider all alternatives before borrowing.
The APR figures disclosed on our website and in our agreements are provided for comparison purposes as required by TILA. They are not representative of the actual annual cost when a loan is used as intended (i.e., repaid within 14โ30 days).
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PETALCARD LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES. IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE FINANCE CHARGE PAID ON YOUR MOST RECENT LOAN OR (B) $100.
12. Dispute Resolution & Arbitration
Any dispute arising from or relating to these Terms, our Privacy Policy, or any loan agreement shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Neither party may bring a claim as a class action or in a representative capacity.
Opt-out right: You may opt out of this arbitration clause within 30 days of first agreeing to these Terms by sending a written notice to: Petal Card LLC, Attn: Legal Department, 800 Delaware Ave Suite 200, Wilmington DE 19801. Include your name, contact information, and a clear statement that you are opting out of arbitration.
Nothing in this clause prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction.
13. Governing Law
These Terms shall be governed by the laws of the State of Delaware, without regard to conflict of law principles, subject to applicable federal law and any mandatory consumer protection provisions of your state of residence that cannot be waived by contract.
14. Changes to These Terms
We may modify these Terms at any time. Material changes will be announced by a notice posted prominently on petalcard.us. Continued use of our services after the effective date of a revision constitutes your acceptance of the updated Terms. These Terms do not apply retroactively to signed Loan Agreements โ your signed agreement governs your existing loan.
